Since 1995, Mr. Baker has practiced before the United States Bankruptcy Court representing corporations, partnerships, individuals, and trustees in exceptionally complex bankruptcy and insolvency matters. His practice has focused on the representation of debtors, creditors, lenders, creditors committees, trustees, distressed investors, asset buyers, bankruptcy litigation, and the restructuring and resolution of distressed debt out of court.
Most recently, Mr. Baker was lead counsel to the trustee in the Solomon Dwek bankruptcy proceeding. In that matter, he helped the trustee prosecute more than $100 million in ponzi scheme litigation claims; sell approximately 300 separate pieces of commercial, industrial, and residential real estate; reconcile, reduce and modify more than $3 billion in claims filed against 81 separate, but related corporations; and obtain unanimous approval for a plan of liquidation that substantively consolidated all of the related entities resulting in the return of millions of dollars to creditors.
Prior to that time, for more than a decade Mr. Baker has participated in the successful reorganization of numerous organizations in the restaurant, chemical, metal, retail, fashion, technology and other industries. He also successfully represented hundreds of individuals through the bankruptcy process and has testified as an expert witness concerning the impact of bankruptcy on a matrimonial estate. He has represented both debtors and creditors in actions contesting the dischargeability of debts, preferences and fraudulent conveyances.
